Welcome to the Lone Oak website. These Terms & Conditions ("Terms") govern your access to and use of the Lone Oak website and its content, features, booking inquiry forms, artist information, and related services. By accessing or using this website, you acknowledge and agree to these Terms. If you do not agree with these Terms, please discontinue use of the website.
1. About Lone Oak
Lone Oak provides artist, entertainment, promotional, and booking-related information to individuals and organizations interested in engaging performers or entertainment services. Information presented on the website is intended to assist prospective buyers, venues, churches, promoters, organizations, event planners, and other interested parties in learning about available artists and submitting booking inquiries.
2. Booking Inquiries
Submitting a booking inquiry through the Lone Oak website does not constitute a confirmed booking, does not create a binding agreement, does not guarantee artist availability, does not guarantee a particular performance fee or rate, does not place an artist on hold unless Lone Oak expressly confirms otherwise, and does not create an agency, partnership, or other contractual relationship beyond any separately executed agreement.
All engagements are subject to artist availability, scheduling, pricing, event requirements, travel requirements, technical requirements, contract approval, deposits, and any other applicable booking conditions. A performance is not considered confirmed until all required agreements have been executed and any required deposits or payments have been received in accordance with the applicable booking agreement.
3. Artist Availability and Pricing
Artist availability, fees, travel requirements, production requirements, hospitality requirements, and other booking terms may change without notice. Any pricing discussed before a formal agreement is executed should be considered preliminary unless expressly stated otherwise in writing. Lone Oak reserves the right to correct errors or outdated information appearing on the website.
4. Website Content
All website content is provided for general informational and promotional purposes. Lone Oak attempts to maintain accurate and current information but does not guarantee that every artist biography, photograph, schedule, service description, link, or other item will always be complete, accurate, or current. Website content may be modified, updated, removed, or replaced at any time without notice.
5. Intellectual Property
Unless otherwise indicated, the Lone Oak website’s original design, written content, graphics, branding elements, layout, and other proprietary materials are owned by or licensed to Lone Oak and are protected by applicable intellectual-property laws. Artist names, photographs, videos, music, album artwork, trademarks, logos, biographies, and other promotional materials may belong to the respective artists, photographers, management companies, record labels, publishers, licensors, or other rights holders.
Nothing on this website grants visitors ownership of or a license to use such materials except for ordinary personal viewing of the website. You may not reproduce, republish, sell, modify, distribute, commercially exploit, scrape, or create derivative works from website materials without permission from the applicable rights holder.
6. Permitted Website Use
You agree to use the website only for lawful purposes. You may not attempt to gain unauthorized access to the website or its systems; interfere with the operation or security of the website; introduce malicious software, viruses, or harmful code; use automated systems to improperly scrape or harvest website information; impersonate another individual or organization; submit fraudulent booking requests; submit knowingly false or misleading information; use artist information for unauthorized commercial solicitation; or copy or redistribute protected website content without authorization. Lone Oak may restrict access to the website when misuse, abuse, fraud, or unlawful activity is suspected.
7. Third-Party Links
The website may contain links to third-party websites, including artist websites, social-media platforms, streaming services, ticketing services, venues, sponsors, or other organizations. These links are provided for convenience and informational purposes. Lone Oak does not control and is not responsible for the availability, content, privacy practices, security, products, representations, or services of third-party websites. Your use of third-party websites is subject to their respective terms and policies.
8. No Guarantee of Event Results
Lone Oak does not guarantee attendance levels, ticket sales, event profitability, audience response, publicity results, fundraising outcomes, or other results arising from an artist engagement unless expressly agreed to in a separate written contract. Event outcomes depend on numerous factors outside Lone Oak’s control.
9. Contracts Govern Confirmed Engagements
If you enter into a separate artist booking agreement, performance agreement, rider, invoice, or other written contract with Lone Oak, an artist, or an authorized representative, the terms of that agreement govern the applicable engagement. If there is a conflict between these general website Terms and the terms of a separately executed booking agreement regarding a specific engagement, the executed booking agreement will control with respect to that engagement.
10. Disclaimer of Warranties
The website and its content are provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law. 11. Limitation of Liability
To the fullest extent permitted by applicable law, Lone Oak and its owners, representatives, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to use of, or inability to use, the website. This includes losses arising from reliance upon website information, third-party websites, interrupted website access, unauthorized access, or other matters associated with website use. Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
